Facts: This case was really bad. Client was on probation for a first DUI, picked up a second offense DUI while on probation and with a suspended license and a .14% BAC and while that case was pending, he picked up a third DUI while on probation all out of King County, Washington. Client faced a mandatory minimum jail of 30 days for the probation violation, an additional 30 days minimum for the 2nd DUI and a mandatory minimum jail sentence of 180 days for the 3rd offense.

Washington State DUI Consequences - Two Stage Process
When you're arrested for a DUI in the state of Washington, there is at least a two part process to every DUI case. First, you have the criminal case in court. Second, you'll have an opportunity to request a DUI related hearing at the Department of Licensing (DOL). Each process is like a separate case and needs an attorney that is experienced in the strategy of handling both of your cases.
Drivers License Consequences to a DUI in Washington State.
The consequence of losing your DOL case is that you will lose your license to drive. This is a separate case than your court case and most attorneys are unaware of this process.
If you were arrested for a first offense DUI in Washington State, you have 7 days from the day of the DUI to contact the Department of Licensing to request an administrative hearing to fight for your license. There is a mandatory fee of $375.00 to be eligible for this hearing.
The hearing itself is presided over by a hearing officer who acts like your judge, jury , and executioner. What this means is that they will listen to the evidence in your case and determine of they will proceed with the suspension of your license. What is reviewed at the hearing is if the officer who arrested you for your DUI had probable cause to stop you, whether or not you were lawfully arrested, and if your blood alcohol level was above the .08% limit.
